1. General provisions

1.1. www.gustaras.com is a place where you (hereinafter – the Visitor) can use the www.gustaras.com website to purchase prints of art reproductions created by artists on your chosen type of paper. We also offer a platform for artists to showcase their work to the world and earn money by selling it. Additionally, we provide printing services, such as: posters, photo canvases, art prints, photography printing, and wallpaper production.

1.3. The Purchase Rules – the terms and conditions for using the website www.gustaras.com and for purchasing products from www.gustaras.com (hereinafter referred to as the 'Rules') – constitute a legally binding document for the Visitor and the Service Provider (collectively referred to as the 'Parties'). These Rules establish the procedure and conditions for using the www.gustaras.com website, the rights and obligations of the Parties regarding the use of the website and the purchase of gustaras.com products, including payment, delivery, and return conditions and procedures, as well as other provisions related to the ordering, purchasing, and selling of gustaras.com products.

1.4. The Service Provider has the right to change, amend, or correct the Rules at any time. The latest version of the Rules is published on the website www.gustaras.com in the section: Purchase Rules. Changes to the Rules take effect immediately upon their publication on the gustaras.com website. The Service Provider is not required to notify users of changes to the Rules. We recommend periodically visiting the gustaras.com website to review the most current version of the Rules. If significant changes are made, we will provide information about them on the gustaras.com website.

Only the following are entitled to use the gustaras.com website and order and purchase products from gustaras.com (hereinafter - the product):

• competent individuals, i.e., persons who have reached the age of majority and whose capacity is not restricted by court order;

• minors aged sixteen to eighteen may only do so with parental or guardian consent, unless they have permission to independently exercise all civil rights or fulfill obligations;

• legal entities;

• authorized representatives of all the previously mentioned persons;

• by agreeing to the Terms and Conditions, the Buyer confirms that, based on point 1.4 of these Terms and Conditions, they have the right to purchase products.

1.5. The seller reserves the right to terminate the services of the gustaras.com website at any time without notice, and to change the www.gustaras.com website or any of its parts, including all and any of its content.

2. Personal data protection

2.1. The service provider commits to respecting the Visitor's right to privacy concerning their personal information. When handling personal data, gustaras.com adheres to the Personal Data Protection Law and other normative legal acts regulating the processing of personal data, as well as the Visitor's consent, which may be obtained for specific purposes such as e-commerce, direct marketing, surveys, contests, and games. 2.2. By registering on the www.gustaras.com website and purchasing a product from gustaras.com, and by providing your personal data to gustaras.com, the Visitor agrees that gustaras.com may manage and process the personal data or other information provided by the Visitor and use such information for the purposes of providing services on the gustaras.com website and fulfilling the terms of the purchase-sale agreement, in accordance with the conditions specified in the rules.

2.3. By using the services of gustaras.com, the Visitor confirms that they have read and understood the personal data processing rules.

3. Registration

3.1. To use the services of the website gustaras.com, visitors have the option to make a purchase either with registration or without registration. For sellers who wish to create their store environment and offer their products on the www.gustaras.com website, registration is required. Visitors must register and create an account by providing a valid email address, name, surname, and phone number. This information is necessary to create a personal environment and receive information about orders and delivery of gustaras.com products via the provided phone number. This information is essential for creating a personal environment and receiving information about product orders and fund transfers.

3.2. After registering on the gustaras.com website, the Visitor can indicate on their profile that they wish to receive gustaras.com newsletters via their chosen method (email and/or text messages). By selecting the relevant options, the Visitor agrees that the Seller may process their provided personal data (email address and/or phone number) for direct marketing purposes. A minor (i.e., a person aged 16 to 18) providing consent confirms that the consents given for the processing of their personal data for direct marketing purposes have been agreed upon with the minor’s parents/guardians/caretakers, and that they do not object to it.

3.3. The visitor is fully responsible for their actions carried out on the gustaras.com website and must adhere to established behavioral and moral norms. They must use the services in a manner that does not jeopardize the proper functioning, security, and integrity of the gustaras.com website and/or its services, including but not limited to uploading invalid data, spreading viruses, limiting others ability to use the gustaras.com website and/or its services, and undermining the gustaras.com brand, good name, and reputation.

3.4. The seller commits to respecting the rights and dignity of every person and will refrain from insults, mockery, unpleasant or inappropriate comments used in the content of gustaras.com products that directly or indirectly demean/insult another person, offend or harm another individual, or publish any defamatory, vulgar, offensive, discriminatory, or otherwise illegal content that violates legal requirements or leads to any legal liability for the service provider.

3.5. UAB Gustaras (hereinafter referred to as the service provider) is not responsible for the authorship of photographs, illustrations, or textual materials used by the registered visitor and does not verify them. Additionally, the service provider is not responsible for the facts, topics, circumstances, or content errors presented in the textual material and does not verify them. The service provider is partially responsible for the activities carried out by the registered visitor, controls them, and represents them. The provision of services does not imply that the service provider in any way supports or endorses the actions or publication content of the registered visitor. The registered visitor understands and acknowledges that they are solely responsible for all and any information and content placed on their gustaras.com website.

3.6. When uploading a product to the www.gustaras.com website, the Visitor must comply with copyright law and other legal regulations, as well as general principles. By uploading their photos to the gustaras.com website, the Visitor assumes all risks related to possible violations of third parties' privacy. The service provider recommends that the Visitor obtain consent from the mentioned third parties before uploading their photos or information about them to the gustaras.com website.

3.7. The content posted or used by the Visitor for gustaras.com products (e.g., photos, illustrations, information, and other content) on the gustaras.com website remains the property of the Visitor. By using the services of the gustaras.com website, the Visitor grants the Service Provider the right to reproduce the content in print and perform other related services, including storage, of the content posted/used by the Visitor.

3.8. The service provider reserves the right, at its discretion and judgment, to remove any prohibited information or information that contradicts legal regulations, established behavioral norms, or moral standards from the gustaras.com website.

3.9. We recommend carefully choosing your password when registering on gustaras.com and not sharing it with others! The visitor is responsible for the transfer of login details to third parties. If third parties use the visitor's login details, the visitor is responsible for the actions performed by those third parties.

3.10. The visitor has the right to discontinue using the services of the gustaras.com website at any time by submitting a request to the Service Provider in the Contact section of the gustaras.com website, using the email address specified during registration on the gustaras.com website.

4. Order

4.1. Before purchasing products from gustaras.com, the Visitor must additionally provide a delivery address, which is necessary for their delivery.

4.2. The visitor has the right to stop using the services of the gustaras.com website at any time by submitting a request to the Service Provider via the email address provided in the 'Contacts' section of the gustaras.com website, using the email address that was provided during registration on the gustaras.com website.

4.3. The visitor must carefully review the order layout for any possible errors and inaccuracies before submitting the order, as once the order is submitted, the visitor will not have the opportunity to make corrections and will be responsible for covering all order processing costs.

4.4. The Visitor has the right to discontinue using the gustaras.com website services at any time by submitting a request to the Service Provider in the 'Contact' section of the gustaras.com website, using the email address provided during the registration process on the gustaras.com website. When the Visitor clicks the 'ORDER' link, it is considered that a Purchase-Sale Agreement has been established between the Visitor and the Service Provider for the acquisition of a gustaras.com product, and from that moment, the Visitor is referred to as the Buyer, and the Service Provider as the Seller.

5. Conclusion of a purchase-sale agreement

5.1. Purchase-Sale Agreement - an agreement made between the Buyer and the Seller for ordering/purchasing products from gustaras.com, consisting of the gustaras.com product order form, which the Buyer submits to the Service Provider through the gustaras.com website, and the Terms and Conditions with subsequent amendments and additions.

5.2. The Buyer must keep the order number secure and not disclose it to third parties who are not authorized to collect goods on behalf of the Buyer. If the order number becomes known to other persons not because the Buyer disclosed it to them, the Buyer must immediately inform the Seller using the contact details provided in the contract. If the Seller does not receive such notification about the unauthorized disclosure of the order number, it is considered that the person is authorized to receive the product(s) and that the product(s) has/have been properly delivered to the Buyer.

6. Buyer's obligations

6.1. By checking the box indicating agreement with the Rules, the Buyer must comply with these Rules, other conditions, and not violate the laws of the Republic of Lithuania and the European Union.

6.2. The buyer must pay for the ordered product and accept it in accordance with the procedures specified in these Terms and Conditions.

According to Article 6.22810, Paragraph 2, Point 3 of the Civil Code, the Buyer does not have the right to exercise the right of withdrawal from the purchase-sale contract if the contract was concluded for goods made according to the special instructions of the consumer, which are not pre-made and are produced based on the consumer's personal choice or instruction, or for goods that are clearly customized to the consumer's personal needs. By agreeing to these Terms and Conditions, the Buyer acknowledges that the ordered product is clearly customized to the Buyer's personal needs and is produced based on the Buyer's personal choice and instruction. Therefore, the Buyer recognizes and agrees that upon placing and paying for the order, they will forfeit the right to withdraw from the purchase-sale contract, except in the case specified in Point 7.2.

7. Buyer’s rights

7.1. The buyer, by using the services of the gustaras.com website, has the right to create and order products from gustaras.com and purchase them in accordance with these Terms.

7.2. If the Buyer receives a defective product, they have the right to cancel the purchase agreement by notifying the Seller in writing (via email at info@gustaras.com, specifying the product to be returned, its order number, and the reason for the return) no later than 5 (five) working days from the date of delivery of the product. The Buyer can exercise this right in accordance with the return conditions set forth in Section 14 and only if the Seller is responsible for the product's defect and if the product has not been damaged or significantly altered in appearance due to the Buyer's fault.

8. Seller's obligations

8.1. The seller agrees to provide the buyer with the opportunity to use the services of the website www.gustaras.com and to purchase a product from gustaras.com.

8.2. The seller agrees to deliver the products purchased by the buyer to the specified address, based on the conditions set forth by these Terms.

8.3. The seller agrees to respect the buyer's right to privacy regarding their personal information.

8.4. If the Buyer exercises the right specified in point 7.2 of the Rules, according to the conditions and procedures of Chapter 14, and only if the Seller fails to meet their obligations, the Seller agrees to refund the money paid by the Buyer within 7 (seven) working days from the date of receipt of the returned product.

9. Seller's rights

9.1. If the Buyer attempts in any way to harm the Seller's work, good name, or reputation, data security, or violates other obligations set out in these Terms, acts dishonestly towards the Seller, tries to circumvent the Terms through deception, abuses the provided privileges and/or discounts, the Seller reserves the right to revoke the Buyer's access to the gustaras.com website or to fully or partially restrict the Buyer's ability to use the gustaras.com website at any time.

9.2. The Buyer agrees that the Seller will unilaterally decide whether the Buyer has violated the Rules and commits to accepting such a decision by the Seller as lawful and correct.

10. Product manufacturing

10.1. Product manufacturing will only begin after the Seller receives payment for the ordered gustaras.com product(s).

10.2. The production times for gustaras.com products are listed on the gustaras.com website in the section: Production Times and Delivery.

10.3. If the buyer does not receive confirmation of the production or shipment of the gustaras.com product within 14 working days, they must contact the designated section on the gustaras.com website: Contact via email, specifying the order number.

10.4. The seller is not responsible for the fact that the color of the product on gustaras.com may not match the color of the product as displayed on the buyer’s monitor.

10.5. www.gustaras.com products are made in the European Union.

11. www.gustaras.com product prices

11.1. On www.gustaras.com, product prices are listed in euros and dollars. VAT is included in the price. VAT invoices are issued in the currency of the Republic of Lithuania - euros. The prices on gustaras.com do not include delivery charges for goods.

12. Seller's obligations

12.1. The buyer settles the payment for the ordered product(s) via electronic banking through the PayPal payment system when the prepayment is made using the electronic banking system employed by the buyer.

12.2. The moment of receiving payment is considered to be when the Seller receives the payment instruction in their bank account.

12.3. Without receiving payment, the Seller will keep the Buyer's order in the system for 15 days. If the Seller does not receive payment within these 15 days, the order will be canceled.

13. www.gustaras.com product delivery

13.1. The Seller agrees to deliver the ordered product to the Buyer in accordance with the terms specified in the 'Production Terms and Delivery' section of the gustaras.com website and commits to making every effort to ensure that the purchased product is delivered as quickly as possible. The Buyer agrees that in the event of unforeseen circumstances beyond the Seller’s control, the delivery time of the products may differ from the terms specified in this section or the delivery time agreed upon by the Buyer and Seller.

13.2. Ordered products are delivered using the delivery method specified by the Buyer in the product order application. Delivery charges for products are listed on the gustaras.com website in the section: Production Times and Delivery. The Buyer agrees to provide the exact delivery address and a contact phone number.

13.3. Once the seller has dispatched the shipment, the buyer will be provided with a tracking number, which the buyer can use to track the shipment from the moment the seller sends it until the buyer receives or accepts it. The direct route of the order shipment can be monitored through the parcel service/courier’s self-service “shipment tracking.”

13.4. If the products are delivered by the Seller's authorized representative, such as a courier or shipping service, the product is handed over to the Buyer, and the fact of delivery is recorded according to the procedures established by the courier or shipping service.

13.5. If the Buyer chooses the courier/shipping service delivery method, they commit to accepting the ordered product themselves. In cases where the Buyer is unable to accept the product personally, and the product is delivered to the address provided by the Buyer and based on other information provided by the Buyer, the Buyer does not have the right to make claims against the Seller regarding the delivery/transfer of the product to an incorrect party.

13.6. The buyer, choosing delivery via a parcel locker, will receive an SMS notification about the delivery of the parcel and the deadline by which the recipient must collect the parcel.

13.7. Shipment that was not successfully delivered to the Buyer (e.g., if the Buyer does not pick up the shipment from the parcel locker within the time specified in the SMS notification, or if the address provided for courier delivery is inaccessible, incorrect delivery details are provided, or no contact phone number is provided, etc.) will be returned to the Seller, and the return costs will be transferred to the Buyer. The Buyer, who does not pick up the shipment, is obliged to compensate the Seller for the shipping and return costs (for the shipping service/courier services) in an amount not less than 4.49 EUR (amount may vary depending on the residential region).

13.8. If the product is not delivered to the Buyer or is delivered late, the Buyer must immediately inform the Seller via email at info@gustaras.com. If the Buyer fails to take these actions, the Seller is relieved of responsibility towards the Buyer.

13.9. Upon receiving the product, the Buyer must check the condition of the shipment and the product(s). If the Buyer notices that the shipment packaging is damaged (crumpled, wet, or otherwise visibly damaged), the product(s) are damaged, and/or the product(s) are in incorrect configuration, the Buyer must make a note on the delivery document provided by the courier or draft a separate report of these damages with the courier present and immediately, but no later than 2 (two) working days from the date of receipt of the shipment, inform the Seller by email at info@gustaras.com, specifying the fact of the product damage (non-compliance) and its cause. If the quality of the product has not been affected by the damaged packaging, the Buyer may accept the product, notifying the Seller by email at info@gustaras.com that only the shipment packaging was damaged. If the Buyer fails to take these actions, the Seller is relieved of responsibility towards the Buyer for product damage, unless such damage is due to a manufacturing defect, and for discrepancies in the product configuration, provided that these discrepancies can be identified upon inspection of the product. If the Buyer does not notify the Seller of product damage or discrepancies within the timeframe specified in this section, the shipment is considered to have been delivered in good condition, with no damage attributable to causes other than manufacturing defects, and no discrepancies in the product configuration.

13.10. When shipping/delivering gustaras.com products outside of the Republic of Lithuania and/or the EU Customs Union, import duties may apply to the product(s). Import duties are not included in the product price. The buyer is responsible for paying any taxes related to the product(s), including but not limited to any import duties, customs fees, VAT, and other applicable taxes.

14. Product return

14.1. A quality product is non-exchangeable, non-returnable, and the money paid by the Buyer is non-refundable.

14.2. Product defects are remedied or defective products are replaced if the Seller is responsible for the quality deficiencies of the product.

14.3. The Buyer may exercise the right to return a defective product within 5 (five) working days from the date of delivery by notifying the Seller in accordance with the procedure specified in Clause 7.2 of the Rules.

14.4. When returning a defective product, additional conditions must be followed:

• the returned product must be undamaged by the Buyer;
• the returned product should preferably be returned in the Seller's packaging or in another packaging that ensures safe transportation/shipping;
• when returning a product, it is necessary to provide a document confirming its purchase;
• the seller has the right to refuse to accept the products returned by the buyer if the product return conditions were not followed.

14.5. For the return of a defective product, the Buyer should contact the Seller at info@gustaras.com. The Seller will generate a return label and send it to the Buyer via email. The received return label must be affixed to the securely packaged shipment. The shipment can be returned by a method convenient for the Buyer, either by courier or parcel locker, regardless of how the Buyer originally received the shipment. The cost of returning a product with defects is covered by the Seller.

14.6. If the Seller is responsible for the product's deficiencies and it is not possible to correct the deficiencies, the money paid for the returned products will be refunded to the Buyer only through a bank transfer to the payer's bank account.

15. Complaints, negative reviews or evaluations

15.1. The seller strives to provide the buyer with an excellent experience when purchasing products from gustaras.com. However, if the buyer is dissatisfied with a gustaras.com product or service, they are encouraged to first contact the seller directly at info@gustaras.com so that the seller can resolve the dissatisfaction or issue as quickly as possible.

15.2. Upon receiving a customer complaint, negative feedback, or review, the Seller will make every effort to find the most appropriate individual solution to address the buyer's complaint or dissatisfaction.

15.3. If the Buyer does not agree with the received response or decision, or has additional important information that was not provided or considered, it is recommended to contact the Seller again.

15.4. If the decision is not accepted or the Buyer remains dissatisfied with the decision, the Buyer may use other dispute resolution methods.

16. Providing information

16.1. The Seller provides information to the Buyer using the email address provided in the Buyer's registration form, and the Buyer can use all communication channels listed in the 'Contact' section of the gustaras.com website.

16.2. The buyer, by agreeing to these Terms, consents to receiving informational messages at the email address they have provided, which are necessary for the execution of product orders, payment, and delivery.

17. Responsibility

17.1. The Visitor/Buyer agrees to fully compensate the Service Provider/Seller or any other person who has suffered damage as a result of the Visitor/Buyer’s actions using the gustaras.com website and/or services, for any damage caused due to justified claims made by third parties in writing regarding violations of their rights.

17.2. The Service Provider/Seller is exempt from any liability in all cases where losses occur because the Visitor/Buyer, disregarding the recommendations and obligations of the Service Provider/Seller, did not familiarize themselves with these Terms and Conditions, despite having been given the opportunity to do so.

17.3. Once the damage occurs, the responsible party compensates the other party for direct losses.

18. Final provisions

18.1. These Rules are created in accordance with the legal acts of the Republic of Lithuania.

18.2. The relationships arising under these Rules are governed by the laws of the Republic of Lithuania.

18.3. Disputes arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania, based on the location where the Service Provider/Seller operates.

18.4. In the Republic of Lithuania, consumer disputes are resolved through non-judicial procedures by the State Consumer Rights Protection Authority, located at Vilniaus g. 25, LT-01402 Vilnius. Website: www.vvtat.lt.

18.5. Requests or complaints regarding products purchased on the gustaras.com website can be submitted through the online dispute resolution platform at http://ec.europa.eu/odr/.
